Are There Upfront Fees When Filing a Product Liability Claim?

Have you ever wondered what the upfront costs are for bringing a product liability or a product defect claim? The answer to that is actually pretty easy.

My name is David Salazar. I’m an attorney based in Houston, Texas, and I practice all over the country. We help people who have been injured by defective or recalled items, including automobiles and faulty or malfunctioning baby products. Household items that you would normally not think of as hazardous can actually be extremely dangerous.

Contingency fee attorneys

So what is the answer to the question above? Zero. You have to pay zero in upfront fees when filing a claim. Here”s why: We are what’s called contingency fee attorneys. If you hire such an attorney to file a claim for you, the attorney basically takes the risk by accepting your case and front-loading all of the expenses of the case.

If there are any attorneys out there who ask you to pay for the expenses for a product defect case, don’t hire that attorney. You need to choose an attorney that works purely on a contingency fee, where they are going to front any and all expenses that are related to the case.

When will the attorney get paid?

So when does the attorney get paid? Provided that the attorney makes a recovery for you. when your case gets settled, the attorney gets a portion of that settlement along with the expenses. And that’s the balance they’re in whenever you bring a product liability case.

A lot of people ask me, “Why don’t you actually take cases on an hourly basis?” It’s just not cost effective or beneficial to the client if you take it like that. What happens if you work on the case for hours and hours and hours and then you find out there’s actually nothing there as far as the recall goes? It just doesn’t make any sense.

Attorneys have developed the contingency fee system to try to make sure that it’s beneficial to everyone, including the client, whenever there’s a case like this. As a result, you have to pay nothing upfront. And that’s why we’re in the business. We accept that risk and work on the case, and at the very end, we take a portion of the settlement, along with our expenses.
